1. Acceptance of Terms

By accessing or using AutoVidSync ("the Service"), operated by MyersMedical, LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. Your continued use of the Service after any changes to these terms constitutes acceptance of those changes.

2. Description of Service

AutoVidSync provides automated video generation and social media publishing services, including:

  • Automated video generation from RSS feeds, articles, and custom prompts
  • AI-powered script generation and voice narration
  • Automated publishing to connected social media accounts (YouTube, TikTok)
  • Scheduled content publishing and automation
  • Analytics and growth tracking for your social media channels

3. Account Responsibilities

When you create an account with AutoVidSync:

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You must have legal rights to any content sources (RSS feeds, articles) you provide to the Service
  • You are responsible for all activities that occur under your account
  • You must be at least 13 years old to use the Service

4. Content Guidelines

Ownership

You retain ownership of all content you create using AutoVidSync, including generated videos, scripts, and media. However, you grant us a limited license to process, store, and publish this content on your behalf to connected social media platforms.

Prohibited Content

You must not use AutoVidSync to create or distribute content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of others
  • Contains hate speech, harassment, or discriminatory content
  • Promotes violence, illegal activities, or self-harm
  • Contains sexually explicit or inappropriate material
  • Spreads misinformation or deceptive content
  • Violates the terms of service of YouTube, TikTok, or other platforms

Platform Compliance

All generated content must comply with the community guidelines and terms of service of the platforms where you choose to publish (YouTube, TikTok, etc.).

5. Social Media Platform Compliance

When you connect your social media accounts to AutoVidSync:

  • You must comply with YouTube's Terms of Service
  • You must comply with TikTok's Terms of Service
  • We are not responsible for actions taken by platforms against your accounts, including suspensions, bans, or content removal
  • Platform changes, API deprecations, or policy updates may affect Service functionality
  • You can disconnect social media accounts at any time from your account settings

6. API Usage and Rate Limits

The Service is subject to limitations imposed by third-party APIs and platforms:

  • Video generation and publishing are subject to platform API rate limits
  • We may throttle usage to comply with third-party service limitations
  • Service availability may be affected by third-party API downtime or changes
  • We reserve the right to implement fair usage policies to ensure service stability

7. Payment Terms

Subscription Billing

  • Subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice to existing subscribers
  • Failed payments may result in service suspension

Refund Policy

Refunds are generally not provided for unused subscription periods. However, we may consider refund requests on a case-by-case basis for service outages or technical issues that prevent normal use of the Service.

Service Tier Limitations

Each subscription tier has specific limits on videos per month, connected channels, and publishing frequency. Upgrading or downgrading tiers will take effect at the next billing cycle.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

  • We do not guarantee uninterrupted or error-free service
  • We are not liable for content generated by AI that may be inaccurate or inappropriate
  • We are not responsible for platform changes, API deprecations, or account suspensions
  • We are not liable for lost data, revenue, or business opportunities
  • Our maximum liability to you is limited to the fees you paid in the 12 months preceding the claim
  • We are not responsible for third-party service failures or downtime

9. Termination

Your Rights

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access until then.

Our Rights

We may suspend or terminate your account immediately if you:

  • Violate these Terms of Service
  • Create prohibited content or abuse the Service
  • Engage in fraudulent activity or payment disputes
  • Violate platform terms (YouTube, TikTok) in a way that risks our API access

Upon Termination

When your account is terminated or you cancel:

  • All connected social media accounts will be automatically disconnected
  • Your data will be retained for 30 days, then permanently deleted
  • You may export your data before deletion via account settings
  • No refunds will be provided for unused subscription time

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Washington County, Marietta, Ohio. You consent to the personal jurisdiction of these courts.
